1. Scope and acceptance
These Terms of Service form an agreement between the person accessing the services and DJOE, a technology project operated in Quebec, Canada. They apply to DJoe.ca, the KOS Discord application and bot, related portals, prototypes, AI agents, and automation or data-integration services made available by DJOE.
By using a service, authorizing KOS on Discord, or submitting a command, you confirm that you have read and accepted these terms. If you act for an organization, you confirm that you have authority to bind it. Do not use the services if you do not agree.
2. DJOE and KOS services
DJOE develops AI automation for small and medium-sized businesses, conversational agents, software integrations, document workflows, and operational dashboards. KOS acts as an orchestration core that receives authorized instructions, coordinates tools and artificial intelligence models, and presents results for human review.
Available features depend on the project, workspace, Discord permissions, and integrations that have been enabled. A demonstration, prototype, or description of a future capability is not a promise of commercial availability.
3. Eligibility
You must have legal capacity to accept these terms and meet the minimum age required by Discord and applicable law. The services are not directed to children under 14 without valid parental or guardian authorization where required.
An organization remains responsible for deciding which employees, contractors, or collaborators may use KOS and what information they may submit.
4. Discord authorization and account security
KOS may request Discord permissions needed to respond to commands, access server context, or process content explicitly directed to the application. Review requested permissions before installation and remove permissions that are no longer needed.
You are responsible for securing Discord accounts, roles, channels, and integration keys. Never place a password, bot token, API key, or authentication secret in a conversation, command, or attachment.
5. User content and instructions
You retain your rights in the text, files, images, instructions, and other material you submit. You grant DJOE a limited permission to host, reproduce, transform, and disclose that material to enabled providers only as needed to complete the request, secure the service, and comply with law.
You represent that you are authorized to submit the material. Do not provide personal, confidential, medical, financial, or business information that is unnecessary or that you are not authorized to process.
6. Artificial intelligence output
Artificial intelligence models may produce inaccurate, incomplete, outdated, or unsuitable output. KOS output is a work aid and not a guarantee of truth. It is not a substitute for qualified legal, medical, accounting, cybersecurity, engineering, or other regulated professional advice.
A competent person must validate important decisions before material is sent to a customer, published, billed, or executed. KOS is not intended to independently make decisions that create legal or similarly significant effects for a person.
7. Acceptable use
You may not use the services to break the law, violate Discord rules, harass others, distribute malware, evade security, gain unauthorized access, impersonate someone, generate spam, exploit children, infringe intellectual property, or facilitate deceptive or dangerous activity.
You may not probe, overload, reverse engineer, or repurpose KOS, or attempt to extract secrets, internal instructions, another workspace’s data, or another user’s information.
8. Third-party platforms and providers
The services may interact with Discord, cloud infrastructure, email services, APIs, and AI model providers. Their own terms and policies also apply. DJOE does not control a third party’s availability, product changes, or decisions.
An optional integration is enabled only in the agreed context. Compatibility with the DJOE architecture does not mean that every request is automatically sent to that provider.
9. Intellectual property
DJOE retains its rights in KOS, its architecture, source code, interfaces, brands, workflow templates, documentation, and visual assets, subject to licences that apply to open-source and third-party components. Access does not transfer ownership.
Rights in custom deliverables may be addressed in a separate commercial agreement. Without one, you receive only a limited, revocable, non-transferable right to use the service for authorized business purposes.
10. Beta features, availability, and changes
An experimental feature may be modified, suspended, or removed without notice. DJOE works toward reliable service but does not promise uninterrupted availability, error-free operation, or permanent compatibility with every software product or Discord version.
Maintenance, technical incidents, API limits, or security requirements may temporarily interrupt service. DJOE may apply reasonable limits to protect infrastructure and users.
11. Commercial services and payments
Prices, taxes, usage limits, payment terms, deliverables, and service levels for paid work are set out in a separate proposal, contract, or order. Nothing on this page alone is a binding quotation.
If documents conflict, the signed commercial agreement controls the relevant service while these terms continue to govern matters it does not replace.
12. Privacy
Personal information practices are explained in the DJOE and KOS Privacy Policy. Your organization must also meet its own confidentiality duties and provide notices when personal information is processed through automation or an external provider.
13. Suspension and termination
DJOE may restrict or suspend access where there is a security risk, prohibited use, legal requirement, applicable payment default, or possible harm to another person’s rights. Where reasonably possible, the user will be informed and allowed to correct the issue.
You may stop using KOS, remove it from a Discord server, and revoke its permissions. Some information may remain for legal obligations, security, backups, or dispute resolution.
14. Warranties and limitation of liability
To the extent permitted by law, development services are provided “as is” and “as available.” DJOE does not warrant that AI output will be fit for a particular purpose. You remain responsible for review, backups, and decisions made from any output.
DJOE is not liable for indirect damages, lost profits, lost data, or interruption caused by a third party, incorrect configuration, or use contrary to instructions, except where the law prohibits such an exclusion. These terms do not limit a consumer right that cannot legally be waived.
15. Governing law
These terms are governed by the laws of Quebec and the federal laws of Canada applicable there. The parties should first try to resolve a dispute in good faith. Courts with jurisdiction in Quebec may hear disputes, subject to mandatory consumer protections.
16. Changes and contact
DJOE may update these terms to reflect new features, legal requirements, or provider changes. The date shown at the top will be revised, and additional notice will be provided when a material change requires it.
Questions about these terms may be sent to djoebase@proton.me.
